1. About these Terms

These Terms and Conditions govern your use of List It Global (listitglobal.com), an online classified advertising platform operated by Listitglobal.com, registered at Manhattan, New York, United States. By creating an account, posting an advertisement, or otherwise using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years old to create an account or post an advertisement. By using the Site you confirm you are 18 or over and legally able to enter into binding contracts. We may suspend or remove any account we reasonably believe belongs to a person under 18.

3. Our role: we are a venue, not a party to your transaction

This is the most important term in this document. List It Global is a listings platform. We are not a party to any agreement between a buyer and a seller. We do not own, inspect, possess, guarantee, or deliver any item or service advertised on the Site. We do not process payments between users, verify the accuracy of listings, or confirm that a seller has the right to sell what they advertise.

Any transaction you enter into is solely between you and the other user. You are responsible for satisfying yourself as to the identity of the other party, the condition and legality of the item or service, and the safety of any meeting or payment arrangement.

You use the Site at your own risk. By creating an account, browsing listings, contacting another user, responding to an advertisement, or entering into any transaction arranged through the Site, you acknowledge and accept that:

other users may misrepresent themselves, their identity, their location, or the items or services they advertise;
listings may be inaccurate, incomplete, misleading, fraudulent, or unlawful;
items may be defective, counterfeit, stolen, unsafe, or may never be delivered;
payment you send to another user may not be recoverable;
meeting another user in person carries personal safety risk;
we do not verify users, listings, items, qualifications, licences, or the right to sell.

You assume full responsibility for these risks and for any loss, damage, injury, or cost you suffer as a result. You are solely liable for your own decisions, including who you deal with, what you buy or sell, how you pay, and where you meet. To the fullest extent permitted by law, List It Global accepts no liability whatsoever for the acts, omissions, conduct, statements, or content of any user, or for any dispute, loss, fraud, or misrepresentation arising between users.

We strongly recommend that you inspect items before paying, use traceable payment methods, meet in public places, and never send money to someone you have not verified.

4. Your account

You may register directly or by signing in with Google. You must provide accurate information and keep it current. You are responsible for all activity under your account and for keeping your credentials secure. Notify us immediately at support@listitglobal.com if you believe your account has been compromised. You may not create multiple accounts to evade moderation or suspension, or transfer your account to anyone else.

5. Posting advertisements

You are solely responsible for the content of your advertisements. By posting, you confirm that:

you own the item or are authorised to sell or advertise it;
the listing is accurate, not misleading, and placed in the correct category and location;
the item or service may lawfully be sold and advertised in your jurisdiction and in the jurisdictions where your listing will be visible;
you own or are licensed to use all text and images you upload;
you will comply with all applicable consumer protection, advertising, tax, and trading laws, including any obligation to disclose that you are acting as a business.

Advertisements are reviewed before publication and remain live for 60 days unless renewed, removed, or withdrawn earlier.

6. Prohibited and restricted content

You must not list, offer, or advertise:

weapons, firearms, ammunition, explosives, or components of them;
illegal drugs, controlled substances, drug paraphernalia, or unapproved medicines;
stolen goods, or items with removed, altered, or falsified serial numbers;
counterfeit, replica, or infringing goods;
sexual services, pornography, or sexually explicit material;
human remains, body parts, or bodily fluids;
endangered species, protected wildlife, ivory, or products derived from them;
personal data, contact lists, or account credentials;
tobacco, vaping products, or alcohol where prohibited by local law;
securities, cryptocurrency investment schemes, or offers of credit requiring regulatory authorisation you do not hold;
recalled products, or goods that fail applicable safety standards;
government documents, identity documents, uniforms, or badges;
hacking tools, surveillance devices, or services intended to compromise systems or privacy;
multi-level marketing or pyramid schemes, or work-from-home offers requiring upfront payment;
anything else prohibited by applicable law.

Live animal listings, vehicles, property rentals, and job advertisements are subject to additional legal requirements in many countries. You are responsible for meeting them.

7. Prohibited conduct

You must not: post the same item repeatedly to gain visibility; use the Site to send spam or unsolicited commercial messages; harass, threaten, defraud, or impersonate any person; scrape, crawl, or harvest data by automated means; attempt to bypass our security, moderation, or rate limits; or interfere with the operation of the Site.

8. Moderation, suspension, and removal

We may review, refuse, edit, suspend, or remove any advertisement or account at our discretion, with or without notice, including where we believe these Terms have been breached or where a listing creates legal or reputational risk. We are not obliged to monitor content, and our decision to moderate some content does not create an obligation to moderate all of it.

9. Messaging and reviews

The Site provides direct messaging between users and allows reviews of sellers. Messages must relate to a genuine enquiry. Reviews must be honest, based on a real interaction, and must not contain personal data about third parties, abuse, or unlawful content. We may remove reviews that breach these standards.

10. Your content and the licence you grant us

You retain ownership of the text and images you upload. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for formatting purposes, and display that content for the purpose of operating and promoting the Site. This licence ends when you delete the content, except for copies retained in backups or where we must retain it to comply with a legal obligation.

11. Intellectual property

The Site, its design, and its software are protected by intellectual property rights owned by us or our licensors. You may not copy, reproduce, or create derivative works from them except as permitted by law.

12. Third-party services

The Site uses Google Maps and Google Places for location features, Google reCAPTCHA for security, and Google Sign-In for optional authentication. Your use of those features is also subject to Google’s terms. Links to third-party websites are provided for convenience and we are not responsible for their content.

13. Disclaimers

The Site is provided as is and as available. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including as to accuracy, fitness for a particular purpose, and uninterrupted availability. We do not warrant that listings are accurate, lawful, or that users are who they claim to be.

14. Release of claims between users

If you have a dispute with another user, you release List It Global, its owners, operators, employees, and agents from any and all claims, demands, damages, losses, and liabilities of every kind, known and unknown, arising out of or connected with that dispute. This includes claims relating to fraud, deception, misrepresentation, non-payment, non-delivery, defective or counterfeit goods, personal injury, or property damage caused by another user.

If you are a California resident, you expressly waive California Civil Code section 1542, which states: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

14 A. Limitation of liability

To the fullest extent permitted by law, List It Global is not liable for any loss or damage of any kind arising from or connected with your use of the Site, including direct, indirect, incidental, special, punitive, or consequential loss, and including loss of profit, revenue, data, business, or goodwill, whether arising in contract, tort (including negligence), or otherwise, and whether or not we were advised of the possibility of such loss.

Without limiting the above, we are not liable for: the conduct or content of any user; any transaction between users; any item or service advertised; unauthorised access to your account; interruption, suspension, or termination of the Site; or loss of listings or data.

Where liability cannot lawfully be excluded, our total aggregate liability to you for all claims arising in any twelve-month period is limited to the greater of (a) the total fees you paid us in that period, or (b) USD 100.

Exceptions. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for our own fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. If you are a consumer, you retain all mandatory rights under the law of your country of residence, and nothing in these Terms affects those rights.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of incidental or consequential damages. In those jurisdictions our liability is limited to the greatest extent permitted by law.

15. Indemnity

You agree to indemnify us against claims, losses, and reasonable legal costs arising from your advertisements, your breach of these Terms, or your infringement of the rights of a third party.

16. Suspension and termination

You may close your account at any time from your account settings. We may suspend or terminate your access where you breach these Terms or where required by law. Sections which by their nature should survive termination will do so.

17. Changes to these Terms

We may update these Terms. Where changes are material we will give reasonable notice, for example by email or an on-site notice. Continuing to use the Site after changes take effect constitutes acceptance.

18. Governing law and disputes

These Terms are governed by the laws of the State of New York, United States, and the courts of the State of New York, United States have exclusive jurisdiction, except that if you are a consumer resident in the European Union or United Kingdom you may also bring proceedings in your country of residence and benefit from mandatory protections of that country’s law.
